Effective October 7, 2026
These Terms of Service ("Terms") govern your use of the website at cardlynfcscanner.com, the CardlyNFCScanner Android application, and all tools, accounts, links and pages provided through them (together, the "Service"), provided by Kenan Killi, trading as CardlyNFCScanner ("we", "us", "our").
By creating an account, using any tool, or opening a link we host, you accept these Terms. If you do not accept them, do not use the Service.
Purchases of physical products are governed separately by our Terms of Sale, Shipping Policy and Refund & Return Policy. These Terms govern the software and the hosted pages.
1. WHO WE ARE
Kenan Killi, trading as CardlyNFCScanner, New York, United States. Contact: cardlynfcscanner@gmail.com
2. WHAT THE SERVICE IS
The Service lets you create and host content reached by tapping an NFC tag, scanning a QR code, or opening a link. Depending on your plan it includes digital business card and CV pages, NFC read/write/erase functions, utility tools, Lost & Found and Recovery Tag pages, venue pages for businesses, AI-assisted creation features, and a code snippet library.
We may add, change or withdraw any feature at any time.
3. ELIGIBILITY
You must be at least 18 years old and able to enter into a binding contract. The Service is not directed to children and we do not knowingly allow anyone under 18 to create an account. If you are accepting on behalf of a business, you must be authorized to bind it.
4. YOUR ACCOUNT
You may sign in with an email address and password, or with Google. Each email address corresponds to one account. You may not create multiple accounts to obtain additional free trials, gifts or credits.
You are responsible for keeping your credentials secure and for everything done through your account. Tell us at cardlynfcscanner@gmail.com if you believe your account has been accessed without your authorization.
We may suspend or close an account we reasonably believe has been compromised, is being used in breach of these Terms, or is being used to defraud us or a third party.
5. PLANS, BILLING AND AUTOMATIC RENEWAL
Paid plans are sold as subscriptions. The plan, its price, its billing period and its renewal date are shown to you before you pay.
READ THIS CLAUSE. Subscriptions renew automatically. At the end of each billing period your subscription renews for a further period of the same length and the payment method on file is charged the then-current price for that plan, unless you cancel before the renewal date. We will tell you the renewal date and the renewal amount before your first charge.
You may cancel at any time from your account. Cancellation stops the next renewal; it does not refund the period you are already in. You keep access until the end of the period you have paid for, after which your plan reverts to the free tier and plan-only features stop working.
If a payment fails we may retry it and may suspend paid features until payment succeeds. Prices may change; we will notify you before a change applies to your subscription, and it will take effect from your next renewal, not retroactively.
Payments are processed by Stripe. We do not receive or store your full card number.
6. FREE TRIALS, GIFTS AND PROMOTIONS
A free trial or gifted period, where offered, is limited to one per person and per household. If a trial converts to a paid subscription we will tell you the date and the amount before the first charge, and you may cancel before that date at no cost. We may withdraw or change a promotion at any time, and we may revoke promotional access obtained through duplicate accounts or misrepresentation.
7. CREDITS AND AI FEATURES
Some features consume credits. Plan credits are granted for a billing period; purchased credit packs are additional.
Credits have no cash value, are not a stored-value or gift card product, cannot be transferred or sold, and are not redeemable for money. Purchased credits remain available while your account is open. Plan credits do not carry over between billing periods unless we state otherwise.
AI output is generated automatically. It can be wrong, incomplete, or unsuitable for your purpose, and you are responsible for reviewing anything you publish. Do not submit anyone else's confidential information, and do not rely on AI output for legal, medical, financial or safety decisions. You may not use our AI features to generate unlawful content, to impersonate a real person, or to produce material that infringes someone's rights.
8. YOUR CONTENT
You keep ownership of everything you upload or create ("Your Content").
You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt in format, and publicly display Your Content for the purpose of operating the Service and delivering it to the people you share it with. This licence lasts while Your Content is on the Service and for a short period afterwards while backups cycle out.
You are responsible for having the rights to everything you upload, including photographs of people and any logo or trademark that is not yours.
9. ACCEPTABLE USE
You may not use the Service to:
- publish unlawful content, or content that infringes a copyright, trademark, privacy or publicity right;
- impersonate another person, business or brand, or imply an endorsement you do not have;
- publish a page that imitates a bank, payment provider, government body or any other organization in order to deceive;
- collect payment details, passwords or government identifiers from the people who open your page;
- distribute malware, or link to a page that does;
- harass, threaten or defame anyone, or publish someone's private information without their consent;
- send unsolicited bulk messages using contact details collected through the Service;
- publish sexual content involving minors, or any content that sexualizes a minor;
- scrape, crawl or bulk-download the Service, create accounts or submit forms by automated means, circumvent rate limits, or probe our security;
- resell or redistribute access to the Service without a written Partner (Reseller) Agreement with us.
We may remove content and suspend or close an account for a breach of this clause, without prior notice for a serious breach. A suspension for a content breach does not entitle you to a refund of a subscription period, and does not entitle you to a refund of hardware unless the hardware itself is faulty.
10. NFC TAGS, LINKS AND PRINTED SETUP KEYS
Some products are claimed and managed using a printed key rather than a login. For those products, whoever holds the printed key can configure and edit the page. Treat it like a password: do not photograph it, post it, or include it in a listing photograph.
A one-time setup link, once used, cannot be reissued, and the item is bound to the account or key that claimed it.
Pages reached by tapping a tag are public to anyone holding the tag or the link. We mark them so search engines do not index them, but a public page is public. Do not put anything on one that you would not want a stranger to read.
The NFC write function writes the public view link only. It never writes a management key.
Web NFC is a browser feature outside our control. It works only on supported Android browsers and is not available on iOS browsers. That is a platform limitation, not a fault in the Service.
11. VENUE PAGES, LOYALTY POINTS AND REWARDS
Where a business uses our venue product, that business — not CardlyNFCScanner — is the merchant. The business sets its own menu, prices, rewards, point values and redemption rules, and is solely responsible for honouring them, for the accuracy of its information, and for any offer it makes to its guests.
Loyalty points are a record kept for that business. They have no cash value, are not transferable between venues or between people, are not redeemable for money, and may be adjusted or ended by the business or on closure of its account. Points earned at one venue do not apply at another.
If you are a guest of a venue, any dispute about a reward, a menu item or a reservation is with that business. We are not a party to it.
A venue operator who invites staff to its page is responsible for who it invites and for removing access when someone leaves.
12. THIRD-PARTY SERVICES AND LINKS
The Service relies on third-party providers for payment processing, hosting, storage, email delivery, AI generation and, in the Android application, advertising. We are not responsible for a third party's own service or outage.
Your pages may contain links and payment handles belonging to you or to others — for example a review link, a social profile, or a payment address. We display those; we do not process, hold or verify them, and a payment someone makes to a handle shown on your page is between that person and the payment provider.
13. ADVERTISING
The free tier of the Android application shows advertising supplied by Google AdMob, which collects device and advertising identifiers. See our Privacy Policy. Paid plans reduce or remove advertising as described on the pricing page.
14. OUR INTELLECTUAL PROPERTY
The Service, its software, its design, the CardlyNFCScanner name and the CardlyNFCScanner logo are ours. These Terms give you permission to use the Service; they transfer no ownership. You may not copy our design system, templates or code for a competing product, and you may not use our name or logo without written permission.
Other products and companies named anywhere in the Service belong to their owners and are not connected to us.
15. SUSPENSION, TERMINATION AND DELETION
You may stop using the Service at any time and may delete your account from your settings.
When you delete your account we disable your sign-in, take your hosted pages offline, and remove or anonymize your data in accordance with our Privacy Policy, except where we must keep a record for tax, accounting, fraud-prevention or legal reasons. Deletion is not reversible. Export anything you want to keep first.
We may close an account that has been inactive with no paid plan for a long period, after notice to the email address on file.
16. DISCLAIMERS
The Service is provided "as is" and "as available". We do not warrant that it will be uninterrupted, error-free, or fit for your particular purpose.
We are not a backup service. Keep your own copy of anything important.
Nothing in this clause excludes a right you have under applicable law that cannot be excluded.
17. LIMITATION OF LIABILITY
Nothing in these Terms limits liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot lawfully be limited.
Subject to that: we are not liable for indirect, incidental, special or consequential loss, for loss of profit or business, or for loss or corruption of data; and our total liability arising out of or in connection with the Service is limited to the greater of (a) the amount you paid us for the Service in the twelve months before the claim arose, or (b) one hundred U.S. dollars.
18. INDEMNITY
You will indemnify us against any third-party claim, and any resulting loss, arising from Your Content, from your use of the Service in breach of these Terms, or from your collection or use of other people's personal information through the Service.
19. COPYRIGHT COMPLAINTS
If you believe content on the Service infringes your copyright, write to cardlynfcscanner@gmail.com with "Copyright notice" in the subject line.
Your notice should identify the work, identify the material and where it appears on the Service, give your contact details, and state that you believe in good faith that the use is not authorized and that the information in your notice is accurate. We will remove or disable material in response to a valid notice and will pass the notice to the person who posted it, who may respond with a counter-notice. Submitting a notice or a counter-notice in bad faith can make you liable for damages.
20. CHANGES TO THESE TERMS
We may update these Terms and we keep every published version. For a change that materially reduces your rights or increases your obligations, we will give notice to the email address on file before it takes effect, and it will apply from your next renewal. Continuing to use the Service after a change takes effect means you accept the updated Terms. If you do not accept them, cancel and stop using the Service.
21. GOVERNING LAW AND DISPUTES
These Terms are governed by the laws of the State of New York, without regard to conflict of laws rules. Any dispute will be brought in the state or federal courts located in New York County, New York, and you and we consent to that jurisdiction. Nothing prevents either of us from bringing an individual claim in small claims court.
22. GENERAL
If any clause is found unenforceable, the rest stays in force. Our failure to enforce a clause is not a waiver of it. You may not assign these Terms without our consent; we may assign them to a successor of the business. These Terms, together with any document they refer to, are the whole agreement between us about the Service.
