Effective September 14, 2026 These Terms of Sale ("Terms") govern your purchase of physical products from Kenan Killi, trading as Cardly NFC Scanner ("we", "us", "our"), through cardlynfcscanner.com (the "Site"). By placing an order you accept these Terms. If you do not accept them, do not place an order. 1. WHO WE ARE Kenan Killi, trading as Cardly NFC Scanner, New York, United States. Contact: cardlynfcscanner@gmail.com 2. ELIGIBILITY You must be at least 18 years old and able to enter into a binding contract to place an order. We sell and ship only within the United States. 3. PRODUCTS We sell NFC hardware, including the Cardly NFC Wristband. Product photographs are illustrative; minor variation in color, finish and packaging is normal and is not a defect. Each wristband contains an NTAG216 NFC chip and ships with a printed setup card. The wristband carries a permanent view link encoded on the band itself. The setup card carries a one-time setup link used to claim and configure the band. Once the setup link has been used it cannot be reissued, and the band is bound to the account that claimed it. 4. PRICES AND TAXES All prices are in U.S. dollars and exclude shipping and sales tax unless stated otherwise. Applicable New York State and local sales tax is calculated and shown at checkout. We may change prices at any time; the price that applies to your order is the price displayed when you place it. 5. ORDERS AND ACCEPTANCE Your order is an offer to buy. A confirmation email acknowledges receipt; it is not acceptance. The contract is formed when we dispatch the product. We may decline or cancel an order — and will refund you in full — if the product is out of stock, if the price or description was materially wrong, if we cannot verify your payment or shipping details, or if we suspect fraud or resale abuse. 6. PAYMENT Payments are processed by Stripe. We do not receive or store your full card number. By submitting payment you confirm you are authorized to use the payment method. 7. SHIPPING Shipping, handling times, carriers and delivery estimates are set out in our Shipping Policy, which forms part of these Terms. 8. RETURNS AND REFUNDS Your return and refund rights are set out in our Refund & Return Policy, which forms part of these Terms. 9. RISK AND TITLE Risk of loss passes to you on delivery by the carrier. Title passes when we receive payment in full. 10. ACCEPTABLE USE OF THE LINKED SERVICE The web page your band links to is provided subject to our Terms of Service. You may not use it to publish unlawful content, impersonate another person, or distribute malware. We may suspend a band's linked page for a violation; that does not entitle you to a refund of the hardware unless the hardware itself is faulty. 11. WARRANTY We warrant that the hardware will be free from defects in materials and workmanship for 90 days from delivery, under normal use. This warranty does not cover damage from misuse, cutting, tearing, exposure to solvents, deliberate destruction of the NFC chip, or normal wear. If the hardware fails within the warranty period, contact cardlynfcscanner@gmail.com and we will repair, replace, or refund at our option. Except for this warranty and any rights you have under applicable law that cannot be excluded, the products are supplied "as is". 12. LIMITATION OF LIABILITY Nothing in these Terms limits liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot lawfully be limited. Subject to that, our total liability arising out of or in connection with an order is limited to the amount you paid for that order, and we are not liable for indirect or consequential loss, loss of data, or loss of business. 13. FORCE MAJEURE We are not liable for delay or failure caused by events beyond our reasonable control, including carrier disruption, severe weather, supply failure, and government action. If such an event causes a shipping delay we will notify you and offer the choice of waiting or cancelling for a full refund. 14. CHANGES We may update these Terms. The version that applies to your order is the version in force when you placed it. We record which version you accepted with each order. 15. GOVERNING LAW AND DISPUTES These Terms are governed by the laws of the State of New York, without regard to conflict of laws rules. Any dispute will be brought in the state or federal courts located in New York County, New York, and you and we consent to that jurisdiction.
